Consumer Guarantees

(a) Nothing in this Agreement is intended to exclude, restrict or modify the rights which either of the parties may have under the Australian Consumer Law. (b) A failure to comply with the Consumer Guarantee provisions under the Australian Consumer Law to the extent they apply to this Agreement, the Business' liability is limited to (at its election):
(i) in the case of a supply of goods: (A) replacing the goods or supplying equivalent goods; (B) repairing the goods; (C) paying the cost of replacing the goods or acquiring equivalent goods; or (D) paying the cost of having the goods repaired; and
(ii) in the case of a supply of services: (A) resupplying the services or (B) paying the cost of having the services supplied again.

Capture of Spaces.

South Coast 3D Tours (or its subcontractors) will capture digital imagery of each requested Property at a mutually agreed date and time, and You shall ensure that the Property is available to South Coast 3D Tours (or its subcontractors) at such date and time.
You represent and warrant that You have all necessary permissions and consents to allow South Coast 3D Tours (or its subcontractors) to capture digital imagery of the Property and to upload the collected data to the Matterport Platform to host, display and distribute Models as part of our subscription to Matterport Services.
For each requested Property, South Coast 3D Tours will deliver a shareable 3D model (“Model”). Using a Matterport PRO2 with spatial accuracy of 1% The Model will be delivered electronically, containing links, embed code and access to download links to images and videos for your convenience.

Preparation of the Site

It is the clients responsibility to ensure the space is staged as you would like to display it in the tour.

  • Clean organized and arrange the site

  • Hide personal things

  • Close doors to areas that you don’t want scanned

  • Adjust lighting by turning on all the lights.

  • Turning off all fans and stop all moving objects.

  • Minimize direct sunlight where possible

  • Secure pets outside and advise others to spend time in another room while the scan is in progress.

Outdoor Scans & Joining Multiple Properties

Including outdoor spaces to link buildings or add to tours is not always available due to infrared interference with the cameras sensors however 2D 360 images can be captured and included as links inside the tour. Should you wish to include an outdoor area as part of a walk-through tour please book a tour in the early morning or late evening. Seperate tours can be linked to one another as an alternative solution. Matterport also offers a service to merge multiple scans into a single tour the turn our is 7 - 14 days. No warranties are provided for these services.

Client will review work

The Client promises to provide branding images, information, links, media (images and video) should they wish to have the said material embedded into the tour. The client will describe location placement of these tags. The client will review the work product, to be reasonably available to the Business if the Business has questions regarding this project, and to provide timely feedback and decisions.

3rd Party Services

South Coast 3D Tours provides it's Scanning Services by use of hardware and cloud software supplied by Matterport Inc with its headquarters located at 352 East Java Drive Sunnyvale, CA 94089.

Data owned by you

The tour itself is hosted on the Matterport cloud ecosystem. You are able to link or embed your tour on platforms you manage.
Spatial data can be extracted and is supplied in .XYZ and .OBJ formats for an additional service charge.
Floor Plans are available for purchase if not already included in the selected scan service.
Your Model can be made public, hidden and password protected. The tour will be archived after the free hosting period. If you require your model be available after such time hosting can be purchased or you can request to have your model transfered to your own Matterport account.
South Coast 3D Tours will provide when requested in writing the transfer of scanned spaces to other users accounts within the Matterport Platform.

Invoicing

The Business will invoice the Client after the client approves the final draft and the space is published. The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in the archival of the published space and will no longer be publicly available. To re-activate a scan a late fee may be applied to the invoice

Warranty

The business guarantees it will provide a re-scan of the location if alignment issues are detected or if the tour is not of a satisfactory image quality..
A re-scan may attract an additional fee if the site was not adequately prepared for. See Clause "Preparation of the Site"
After the Final Draft is agreed upon and invoice issued No refunds will be provided for the work completed or services performed under this contract other than in accordance with consumer guarantees under Australian Consumer Law and as otherwise permitted by law.
